Area of Application
These following terms of business by Max Motorcycles Ltd (to be referred to as "vender"), are valid for all contracts which the customer enters into with the vender on the vender´s on-line shop available at www.max-motorcycles.co.uk.
Customers are for these purposes - consumers as well as enterprises. A consumer is an individual who closes a legal deal for any purpose, which will not attribute to his commercial nor his independent professional activity. Also, an enterprise is a legal entity or incorporated partnership, which undertakes a legal transaction in exercise of his independent professional or commercial activity.
Contract formation
The products seen on the vender's on-line shop serve as representations for products available for purchase by the customer. All purchases are legally binding obligations.
The customer can submit an order via email, telephone or by making use of the vender's on-line shop. By entering his personal data and clicking the “order now” button at the end of the on-line order form, the customer hereby enters into a legally binding contract with the vender in which he is obligated to the payment of all products currently found in his shopping cart.
The order data is stored by the vender and can be accessed by the customer after submitting his order by logging into his password-protected customer account. The order data is sent to the customer in text form after an order has been submitted.
Delivery
Once payment is received in full, delivery will be arranged with the carrier of choice. Time frames will be found with the carrier selection option.
Return shipment costs when exercising of the right of cancellation/withdrawal:
A customer has the right to submit a cancellation under Distance Selling Regulations (DSRs). The regular costs of the return postage are imposed on the customer when making a cancellation, unless the delivered product is not consistent with the one ordered.
Royal mail orders must be made before 2pm to be shipped out same day all others 24 hour orders is 3pm.
Prices and Payment Terms
The prices quoted by the vender are final prices, i.e. they contain all price components, excluding Value Added Tax (VAT). Additional shipping and handling fees could be applicable.
For deliveries within the UK mainland the vender will make available the following payment options to the consumer:
Credit card (visa / mastercard)
Debit card (visa debit / Visa electron / Maestro)
PayPal
We do not store credit card details nor do we share financial details with any 3rd parties.
Terms of shipping and delivery as well as the passing of risk:
We attempt to deliver all goods to the delivery address provided by the customer within the time frame stated in the order purchase. This is not a guaranteed service. For faster options it is advised that the customer gets in touch with the vender via email.
If a delivery to the customer is not possible, the product will be returned to the vender and the customer will bear the charges of redelivery.
Right of ownership
All products will remain the property of the vender until full payment has been made by the customer.
Liability
The vender will accept no liability under any terms. It is the duty of the customer to check all products are in safe, working order and have been fitted by a qualified mechanic. However, the vender will undertake a quality control check.
Warranties
No warranties are offered or implied with any products advertised or sold by the vender.
Returns Policy
If the wrong item has been received or the product is faulty, the vender must be informed within 48 hours of delivery to the customer. The vender will then undertake a return for the products(s) and either refund the amount in question or return the item. Items are to be returned by the customer via Royal Mail Second Class Recorded Delivery and proof of postage must be kept by the customer to avoid all risks. If the item is returned due to a fault, the vendor will reimburse the customer. However, in all other matters, payment for return postage is the duty of the customer.
Returns on products will be accepted up to 14 days after the purchase date. The item must be returned by the customer in working, new condition and cost of return postage is to be paid by the customer.
